Driver Platform Terms
These Terms apply to drivers and taxi businesses using Mango’s driver platform in the Netherlands. Mango operates a digital marketplace and dispatch platform. Mango does not employ drivers and does not itself perform the transport service.

1. Independent business status
Drivers using Mango act as independent businesses. Nothing in these Terms creates an employment relationship, agency, partnership, franchise, joint venture, exclusivity obligation, or authority to bind Mango.
Drivers decide when to go online, whether to accept ride offers, and how to organise their business, subject to the legal, safety, and platform rules that apply to Mango’s marketplace.
2. Mango’s role and the transport contract
Mango provides Platform Services that connect Drivers with passengers, facilitate payments and communications, and support dispatch, onboarding, compliance review, billing, and support. The transport contract is concluded between the Driver and the passenger once the ride is accepted.
The Driver is the transport supplier. Mango is not the carrier and is not responsible for the Driver’s legal obligations as a taxi operator, employer, insured party, or taxpayer.
3. Appointment as platform and collection agent
By using Mango, the Driver appoints Mango as disclosed marketplace, collection, and billing agent for rides booked through the platform. Mango may collect passenger payments, issue or facilitate receipts and invoices consistent with the disclosed-agent structure, deduct agreed commissions or adjustments, and remit net amounts through Mango’s payout providers.
Mango may also place temporary holds, defer payout, offset refunds, or retain amounts where reasonably necessary for chargebacks, payment reversals, fraud checks, open complaints, tax/legal obligations, or reconciliation.
4. Eligibility, permits, and compliance
- You must be an independent Dutch taxi business or driver allowed to operate through your own business.
- You must hold and maintain all legally required permits, driver cards, registrations, and taxi-specific insurance.
- For Mango’s Netherlands launch, you must hold your own Dutch taxi operator permit; fleet or on-behalf permit structures are not supported unless Mango explicitly enables them.
- You must provide accurate, current, and complete onboarding, business, tax, payout, and compliance information.
- You must immediately notify Mango of any suspension, expiry, withdrawal, claim, seizure, criminal matter, insurance lapse, or regulatory action relevant to platform eligibility.
5. Onboarding, verification, and continued eligibility
Mango may require KVK verification, payout verification, driver licence checks, taxi driver card checks, operator permit evidence, VOG evidence, vehicle information, insurance evidence, location settings, and other compliance documents before a Driver can go live or continue accepting rides.
Mango may pause access, stop dispatch, or require refreshed documents at any time if a document expires, verification fails, fraud is suspected, or Mango needs updated evidence to satisfy legal, tax, insurance, payment, trust-and-safety, or platform governance requirements.
6. Dispatch, ranking, and ride performance
Mango may use automated or manual ranking and matching systems. Main parameters may include proximity, ETA, availability, active ride status, work area, vehicle category, reliability, cancellation behavior, complaints, verification status, safety signals, scheduled-ride readiness, and platform constraints.
Drivers must perform accepted rides professionally, lawfully, and on time, communicate reasonably through platform channels, and use a roadworthy and compliant vehicle. Repeated cancellations, failure to show, significant lateness, unreliable operation, or off-platform diversion may lead to enforcement action.
7. Conduct, data use, and passenger treatment
- No discrimination, harassment, violence, sexual misconduct, intimidation, or illegal conduct.
- No fraud, forged documents, fare manipulation, review manipulation, account sharing, or misuse of promotions.
- No misuse of passenger personal data; use it only for the booked ride and related support or legal compliance.
- No taking Mango-sourced rides or payments off-platform unless Mango has explicitly enabled that workflow.
8. Platform availability and no service level guarantee
Mango aims to provide stable Platform Services but does not guarantee uninterrupted availability, continuous dispatch volume, a minimum number of ride offers, or any minimum earnings. Maintenance, updates, third-party outages, payment incidents, telecom failures, fraud controls, force majeure, and legal interventions may reduce or interrupt service.
Except where mandatory law provides otherwise, Drivers are not entitled to damages, compensation, or SLA-based claims merely because the platform is temporarily unavailable, a feature is changed, or ride volume decreases.
9. Fees, settlements, and tax responsibilities
Mango may charge platform commissions, service fees, or other disclosed fees related to use of the marketplace. Mango may show gross ride amounts, net payout projections, commission invoices, payout statements, and related accounting records.
Drivers remain responsible for their own taxes, permits, accounting records, insurance, staff, subcontractors, employment law, and regulatory compliance. Mango does not provide tax, employment, or legal advice through the platform.
10. Complaints, restrictions, suspension, and termination
Mango may issue warnings, apply enhanced monitoring, limit features, stop dispatch, suspend access, or terminate access where Mango reasonably believes that action is necessary for safety, fraud prevention, insurance risk, permit or document issues, repeated low-quality service, legal compliance, trust-and-safety, chargeback control, or material breach of these Terms.
In urgent safety or fraud situations, Mango may act immediately without prior notice. For non-urgent measures, Mango aims to record the reason, relevant evidence type, and measure applied, and to provide a statement of reasons where reasonably possible. Drivers may submit an internal complaint or appeal through Mango’s support or legal channels, but an appeal does not automatically suspend an urgent protective measure.
11. Indemnity
To the extent permitted by law, the Driver indemnifies Mango and its affiliates, officers, staff, and contractors against third party claims, losses, fines, tax assessments, penalties, damages, and reasonable costs arising out of or related to the Driver’s transport services, permits, insurance, taxes, staff, subcontractors, regulatory breaches, misconduct, passenger claims, or breach of these Terms, except to the extent caused by Mango’s own unlawful conduct or non-excludable liability.
12. Liability
To the maximum extent permitted by mandatory law, Mango is not liable for the Driver’s business losses, lost profit, loss of earnings, missed ride opportunities, reputational damage, indirect damage, or consequences of regulatory or insurance actions.
If Mango is nevertheless legally liable, that liability is limited to direct damages caused by a material breach of the Platform Services and capped at the total commissions Mango received from the Driver in the three months before the event, or EUR 250 if that amount is higher. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. P2B transparency and complaints
Where Regulation (EU) 2019/1150 applies, this section provides Mango’s core transparency statement for business users. Mango may restrict or terminate access for the reasons described in these Terms and its Driver Enforcement, Suspension & Appeals Policy. Mango maintains an internal complaint channel for business-user complaints about technical issues, enforcement measures, and compliance with these Terms.
Mango may consider mediation in appropriate cases, but is not obliged to waive urgent safety or fraud protections while a dispute is pending.
14. Changes
Mango may update these Terms when the product, regulatory environment, payment model, moderation model, or legal structure changes. Mango will publish the updated version, update the effective date, and where appropriate ask the Driver to accept the updated version before continuing to use the platform.
15. Governing law and contact
These Terms are governed by Dutch law. To the extent permitted by law, disputes will be brought before the competent court in the Netherlands.
